Terms of Use

These Terms of Use (the “Terms”) are a contract between you and 404home (“404home,” “we,” “us,” or “our”). They govern your access to and use of the 404home website, WhatsApp service, messages, provider-research features, and related services (together, the “Service”). By signing up, selecting the required consent box, messaging 404home, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy & AI Data-Use Notice. If you do not agree, do not use the Service.

1. Eligibility and authority

You must be at least 18 years old and legally able to enter into a contract. If you use the Service for another person, household, business, landlord, tenant, homeowners’ association, or property owner, you represent that you have authority to do so. The Service is intended for properties in the metro Atlanta areas that 404home currently supports. Coverage may change and is not guaranteed for every address or request.

2. What 404home provides

404home is a home-services research and referral-information service. You may tell us about a home-service need, and we may research businesses that appear relevant based on factors such as service category, stated service area, public reputation, complaint signals, and contactability. We may then send you a focused list of provider options and publicly available business contact details.

404home does not currently book appointments, dispatch contractors, request quotes on your behalf, negotiate prices, collect contractor payments, supervise work, or send your home profile, request, or contact details to businesses in a shortlist. You decide whether to contact any provider and what information to share. A request does not guarantee that we will identify a provider, that a provider will respond or be available, or that a provider will accept or complete work.

3. Providers are independent businesses

Providers listed or mentioned through the Service are independent third parties. They are not employees, agents, partners, franchisees, or representatives of 404home. 404home does not control their prices, schedules, personnel, methods, advice, safety practices, contracts, warranties, or work.

If you contact or hire a provider, any estimate, booking, payment, cancellation, warranty, and service agreement is directly between you and that provider. 404home is not a party to that agreement and does not receive or hold payment for the provider’s work. A provider’s presence in a shortlist is information for your consideration, not an endorsement, certification, warranty, or guarantee.

4. Your responsibilities

You agree to give us accurate, current, and reasonably complete information and to correct material errors. You are responsible for deciding whether a provider and proposed work are suitable; protecting access codes, keys, alarm details, and valuables; providing a safe worksite; obtaining required owner, landlord, association, or other permissions; and complying with applicable law.

Do not use 404home as a substitute for a qualified inspection, diagnosis, engineer, licensed professional, utility, insurer, lawyer, or emergency service. Do not rely on a message from 404home to delay urgent action. If there may be fire, gas, carbon monoxide, electrocution, flooding, structural failure, violence, serious injury, or another immediate danger, leave the area when appropriate and call 911, the relevant utility emergency line, or another qualified emergency service.

5. Membership and WhatsApp messages

You may need to create a membership profile and verify your WhatsApp number. You are responsible for your account activity and for keeping your device and verification information secure. Tell us promptly at info@404home.ai if you believe your account or number is being misused.

By providing your number and selecting the required consent, you request and agree to receive account and service messages from 404home on WhatsApp. Message frequency varies. Your carrier’s message, data, roaming, or internet charges may apply. Consent to service messages is required for the WhatsApp-based Service but is not consent to receive third-party contractor marketing. You may withdraw consent using WhatsApp’s opt-out controls or by contacting us. Opting out may prevent us from providing a Service that depends on WhatsApp. We may still send non-marketing messages where permitted or required by law.

WhatsApp is a third-party service governed by its own terms and privacy practices. We do not control its availability, security, or delivery.

6. Fees

404home membership is free during the current launch period, and 404home does not charge you for provider work. Providers set and collect their own prices directly from you.

We may introduce paid 404home features in the future, but we will not charge you merely because these Terms change. Before a new charge applies, we will clearly disclose the price, billing basis, renewal and cancellation terms, and any other material conditions, and obtain the agreement or payment authorization required by law. Taxes may apply to future paid features.

7. Privacy and AI-assisted processing

Our Privacy & AI Data-Use Notice explains how we collect, use, disclose, retain, and protect information. It is incorporated into these Terms by reference for notice purposes but does not reduce any privacy right that cannot lawfully be waived.

Some messages may be processed with automated tools, including AI, to help interpret requests, structure home information, support conversations, and identify possible provider options. Automated output can be wrong or incomplete. Do not submit passwords, payment-card data, medical information, or other highly sensitive information through ordinary WhatsApp messages. Review important information and independently verify it before acting.

8. Feedback, reviews, and other content

You retain ownership of content you submit. You grant 404home a non-exclusive, worldwide, royalty-free license to host, copy, transmit, format, analyze, and use that content only as reasonably necessary to operate, secure, maintain, improve, and support the Service, comply with law, and exercise or defend legal rights. This license ends when the content is no longer reasonably needed for those purposes, subject to lawful retention, backups, and records of completed interactions.

You represent that you have the right to submit your content and that it is accurate to the best of your knowledge, lawful, and does not violate another person’s privacy, intellectual-property, publicity, or other rights. Feedback or reviews must reflect a genuine experience. They may not be fake, purchased, coercive, retaliatory, defamatory, discriminatory, harassing, or disclose private information. 404home will not prohibit or penalize an honest review merely because it is negative. We may remove content for a neutral, consistently applied reason such as illegality, fraud, irrelevance, threats, harassment, personal data exposure, or violation of these Terms.

9. Acceptable use

You may not use the Service to break the law; commit or facilitate fraud; impersonate another person; harass, threaten, discriminate against, or harm anyone; submit malicious code; probe or bypass security or rate limits; scrape, harvest, resell, or systematically extract Service data; interfere with operation; create deceptive or abusive accounts; send spam; obtain provider information for unsolicited bulk marketing; or infringe another person’s rights.

You may use provider information for your own legitimate evaluation and contact concerning relevant home services. You may not present 404home’s research or shortlist as a certification, license verification, guarantee, or endorsement.

10. Third-party services and links

The Service may rely on or link to third-party services, including WhatsApp, hosting, database, security, mapping, search, review, communications, and AI providers. Third parties control their own services and may have separate terms. 404home is not responsible for an independent third-party website, platform, information source, or service, except to the extent responsibility cannot legally be excluded or the third party acts as our processor or agent within the scope of that role.

11. 404home intellectual property

The Service, including its software, design, brand, selection and arrangement of content, and 404home-created materials, is owned by 404home or its licensors and protected by law. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No right to use the 404home name, marks, or branding is granted without prior written permission. Third-party names, marks, and content remain the property of their respective owners.

12. Suspension and termination

You may stop using the Service at any time and may request account closure or deletion by emailing info@404home.ai, subject to records we may lawfully retain.

We may limit, suspend, or terminate access when reasonably necessary to address fraud, abuse, security risk, unlawful conduct, threats, repeated material complaints, misuse of provider information, or a material breach of these Terms. Where appropriate, we will give notice and a reasonable opportunity to respond. We may act immediately where delay could create harm or material security or legal risk.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” 404home disclaims implied warranties concerning the Service, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free; that research or third-party information will be complete, current, or accurate; that a provider will respond, be available, or accept work; or that a provider’s advice, price, conduct, or work will meet any standard or be free from defects.

These disclaimers concern 404home’s research and referral-information role. They do not eliminate a provider’s obligations to you, or any warranty, duty, remedy, or consumer right that cannot lawfully be excluded.

14. Limitation of liability

To the fullest extent permitted by law, 404home and its officers, directors, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, data, goodwill, or opportunity; or the acts, omissions, information, communications, pricing, advice, property damage, personal injury, or work of an independent provider or user.

To the fullest extent permitted by law, 404home’s aggregate liability arising from or relating to the Service or these Terms will not exceed the greater of $100 or the amount you paid directly to 404home during the 12 months before the event giving rise to the claim.

The exclusions and cap do not apply to liability that cannot legally be limited, or to 404home’s own fraud, willful misconduct, or gross negligence. Some jurisdictions do not allow certain exclusions or limits; in that event, the affected provision applies only to the maximum extent permitted by law.

15. Indemnification

To the extent permitted by law, you will indemnify and hold harmless 404home and its officers, directors, employees, contractors, and affiliates from third-party claims, losses, penalties, damages, and reasonable legal fees arising from your unlawful use of the Service; your material breach of these Terms; your lack of authority to request work relating to a property; or your infringement or violation of another person’s rights, except to the extent caused by the indemnified party’s own negligence, misconduct, or breach. We will give reasonably prompt notice of a covered claim and allow you to participate in the defense. You may not settle a claim in a way that admits fault by or imposes a non-monetary obligation on an indemnified party without its consent.

16. Disputes, governing law, and courts

Before filing a claim, you and 404home agree to make a good-faith effort for 30 days to resolve the dispute informally. Send a written description of the issue and requested resolution to info@404home.ai. This requirement does not prevent either party from seeking urgent injunctive relief or using small-claims court, and it does not extend a legal limitation period unless the law provides otherwise.

Georgia law governs these Terms, without regard to conflict-of-law rules. Subject to any non-waivable consumer right, the state and federal courts located in Fulton County, Georgia will have exclusive jurisdiction over disputes between you and 404home, and each party consents to their jurisdiction. If you are a consumer, you retain any non-waivable protection available under applicable law.

17. Changes to the Service or Terms

We may change the Service and these Terms to reflect new features, operating practices, safety needs, or legal requirements. We will post revised Terms with a new effective date. If a change is material, we will provide reasonable advance notice through the Service or the contact information associated with your account when practicable. Changes apply prospectively from their stated effective date. Your continued use after that date means you accept the revised Terms; if you do not agree, stop using the Service.

18. General terms

These Terms and the Privacy & AI Data-Use Notice are the entire agreement between you and 404home concerning the Service, except for any additional terms you expressly accept for a specific feature. If a provision is unenforceable, it will be narrowed or severed to the minimum extent necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, financing, sale of assets, or transfer of the Service, subject to applicable law. Headings are for convenience only. Electronic notices and acceptances satisfy any writing requirement to the extent permitted by law. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnity, disputes, and record rights—will survive.
